1. INTRODUCTION
Welcome to TrashMart.
These Terms and Conditions ("Terms", "Terms and Conditions" or "Agreement") govern your access to and use of the TrashMart application, website, services, features and related platforms (collectively, the "Platform" or "TrashMart").
TrashMart is currently operated by an individual and is intended primarily for users in Nigeria.
TrashMart provides a peer-to-peer platform through which users may, subject to these Terms:
- list items for sale;
- list items for donation or giveaway;
- list recyclable materials;
- search for and discover items and recyclable materials;
- create wanted posts for items or materials they are seeking;
- communicate with other users through the Platform;
- interact with listings;
- leave reviews where eligible;
- report users, listings, messages or other content;
- apply for verification where the feature is available; and
- participate in community-oriented features.
TrashMart is a platform for connecting users. Except where expressly stated otherwise, TrashMart is not the seller, buyer, owner, manufacturer, supplier, agent, payment processor, delivery provider or contracting party to transactions between users.
These Terms establish the rules governing use of TrashMart, protect users and the Platform, explain the responsibilities of users, and establish TrashMart's rights to moderate and operate the Platform.
By creating an account, accessing, browsing or using TrashMart, you acknowledge that you have read and understood these Terms and agree to be bound by them.
If you do not agree with these Terms, you must not use TrashMart.
2. ACCEPTANCE OF THESE TERMS
By using TrashMart, you represent and agree that:
- you have read and understood these Terms;
- you agree to comply with these Terms;
- you will comply with all applicable laws and regulations;
- information you provide to TrashMart will be accurate and not deliberately misleading;
- you will not use TrashMart for unlawful, fraudulent, abusive or harmful purposes; and
- you meet the eligibility requirements in Section 4.
Your continued use of TrashMart after changes to these Terms may constitute acceptance of the revised Terms where permitted by applicable law.
If you do not accept a revised version of the Terms, you should stop using the Platform and may contact TrashMart regarding your account.
3. ABOUT TRASHMART
TrashMart is a community-focused peer-to-peer marketplace.
The Platform aims to make it easier for users to:
- reuse items;
- give unwanted items new owners;
- exchange recyclable materials;
- find items they need;
- discover local opportunities;
- connect with other users; and
- participate in environmentally beneficial activity.
TrashMart does not guarantee that every listing, user, message, review, photograph, price, statement or other piece of information appearing on the Platform is accurate, genuine, safe or lawful.
Users are responsible for exercising appropriate judgment and carrying out reasonable checks before interacting with another user or completing a transaction.
4. ELIGIBILITY AND AGE REQUIREMENTS
TrashMart is intended for users who are at least 13 years old.
Users under 18 may use TrashMart subject to applicable law and any additional safeguards or consent requirements that may apply to them.
Where applicable law requires parental or guardian consent for a user's use of TrashMart or for particular processing of their personal data, such consent must be obtained.
Users must not falsely represent their age or otherwise circumvent age-related restrictions.
TrashMart may implement additional safeguards for younger users where reasonably necessary to comply with applicable law, protect users, protect personal data or maintain Platform safety.
TrashMart may restrict or terminate an account where it reasonably believes that:
- a user is below the minimum permitted age;
- a user has falsely represented their age;
- required parental or guardian consent has not been obtained;
- an account is being operated in breach of these Terms; or
- continued use presents a safety, legal or operational risk.
TrashMart does not guarantee that it will be able to identify every underage user.
Parents and guardians are encouraged to discuss safe online marketplace behaviour with minors using the Platform and to provide appropriate supervision where appropriate.
5. ACCOUNT REGISTRATION
Some features require you to create an account.
When creating an account, you must provide information that is reasonably accurate, current and complete.
You must not:
- create an account using another person's identity;
- impersonate another person;
- create an account using intentionally false information;
- create accounts for fraudulent or abusive purposes;
- create multiple accounts for the purpose of circumventing restrictions;
- allow another person to use your account where doing so creates a security or enforcement risk; or
- use another person's login credentials without authorization.
You are responsible for maintaining the security of your account credentials.
You should notify TrashMart if you believe that your account has been compromised, accessed without authorization or otherwise misused.
TrashMart may require additional verification in circumstances where it reasonably considers verification necessary for safety, fraud prevention, account recovery, verification or compliance purposes.
6. EMAIL VERIFICATION
TrashMart may require users to verify their email address.
Where email verification is required, users may be unable to access certain features until verification is completed.
TrashMart may use verified email addresses for:
- account security;
- important service communications;
- verification processes;
- support;
- transaction-related notifications;
- account recovery; and
- other purposes described in the Privacy Policy.
Users must not intentionally provide an email address they do not control for the purpose of circumventing verification requirements.
7. THE ROLE OF TRASHMART
TrashMart provides technology and infrastructure that allows users to discover and communicate with one another.
Unless expressly stated otherwise, TrashMart does not:
- own the items listed by users;
- inspect every item before it is listed;
- manufacture the items;
- guarantee the quality, authenticity, legality or safety of listings;
- act as the user's agent;
- negotiate transactions on behalf of users;
- receive or hold purchase money on behalf of users;
- process payments between users;
- guarantee that a buyer will pay;
- guarantee that a seller will deliver;
- provide transportation or delivery;
- guarantee that a transaction will be completed;
- guarantee that another user will behave honestly; or
- guarantee that a user will honour an agreement made with another user.
TrashMart may, however, take reasonable action to moderate the Platform, investigate reports, remove content, restrict accounts and protect users and the Platform.
Such moderation does not mean that TrashMart guarantees the safety, legality or accuracy of all content or users.
8. USER-TO-USER TRANSACTIONS
Transactions are entered into directly between users.
A user who buys an item enters into the transaction with the seller, not with TrashMart, except where applicable law provides otherwise.
A user who sells or donates an item is responsible for:
- having the legal right to offer the item;
- accurately describing the item;
- accurately representing its condition;
- disclosing material defects or limitations;
- accurately representing the price;
- complying with applicable laws;
- communicating honestly with the other party; and
- fulfilling commitments they voluntarily make.
Buyers are responsible for:
- evaluating listings;
- asking appropriate questions;
- verifying important information;
- considering whether the seller is trustworthy;
- confirming the condition and suitability of an item;
- agreeing on payment and collection/delivery arrangements; and
- complying with applicable laws.
9. PAYMENTS
TrashMart currently does not provide an integrated payment system.
Users may communicate through TrashMart and independently agree on how payment will be made.
Payment arrangements may include methods agreed directly between the parties, subject to applicable law.
TrashMart does not ordinarily:
- receive the buyer's money;
- hold funds in escrow;
- release funds to sellers;
- guarantee payment;
- guarantee refunds;
- verify bank transfers;
- reverse payments;
- act as a financial institution; or
- guarantee that a payment method chosen by users is safe.
Users should exercise extreme caution when sending money to another user.
Users should not assume that a listing, account, verification badge, review, photograph or conversation guarantees that a transaction is legitimate.
Where users choose to complete transactions using external payment services, those services may have their own terms and conditions, policies and protections.
Nothing in these Terms removes rights or protections that cannot lawfully be excluded.
10. FRAUD, SCAMS AND FINANCIAL LOSS
Users must not use TrashMart to:
- defraud another person;
- obtain money through deception;
- impersonate another person;
- provide false payment information;
- create fake listings;
- falsely claim that payment has been made;
- falsely claim that an item has been delivered;
- manipulate transaction evidence;
- solicit money for nonexistent goods;
- engage in phishing;
- steal account credentials;
- launder money;
- facilitate unlawful financial activity; or
- otherwise facilitate fraud.
TrashMart may investigate suspected fraud and may suspend, restrict or terminate accounts where appropriate.
TrashMart may preserve relevant information and cooperate with lawful requests from competent authorities where required or permitted by law.
Users should report suspected fraud as soon as reasonably possible.
11. LISTINGS
Users may create listings for permitted items.
Listings must contain accurate and reasonably complete information.
A listing should accurately represent:
- what is being offered;
- the condition of the item;
- material defects;
- relevant specifications;
- quantity where applicable;
- price where applicable;
- location information where appropriate; and
- photographs or other representations.
Users must not intentionally use misleading descriptions, photographs, titles, prices or other information.
Listings must not falsely imply that TrashMart endorses, guarantees or certifies the seller or product unless TrashMart has expressly stated otherwise.
12. WANTED POSTS
Users may create wanted posts to indicate that they are looking for particular items or materials.
Wanted posts must be truthful and lawful.
Users must not use wanted posts to:
- solicit prohibited goods;
- solicit illegal services;
- request another person's private information;
- facilitate fraud;
- circumvent prohibited-item restrictions; or
- engage in harassment or other abusive activity.
TrashMart may remove wanted posts that violate these Terms.
13. DONATIONS AND GIVEAWAYS
Users may offer permitted items free of charge.
A donation or giveaway does not automatically mean that TrashMart has verified the item's condition, safety or legality.
Users offering donated items must accurately describe known material defects and relevant safety information.
Recipients remain responsible for deciding whether they wish to accept and use an item.
Where an item presents a foreseeable safety risk, users should not offer it through TrashMart.
14. RECYCLABLE MATERIALS
TrashMart may permit listings involving recyclable materials.
Users must comply with all applicable laws concerning the possession, transportation, handling, sale and purchase of recyclable materials.
Users must not list materials that are unlawful to possess, transport, sell or purchase.
Users must not use the Platform to facilitate theft, unauthorized removal of materials, unlawful waste handling or other illegal activity.
TrashMart does not guarantee that any recyclable material listed by a user is correctly classified, safe or legally sourced.
15. PROHIBITED ITEMS AND ACTIVITIES
Users must not list, request, sell, donate, purchase, exchange or otherwise facilitate prohibited goods or activities.
Prohibited content and activity includes, without limitation:
Illegal goods
- stolen goods;
- unlawfully obtained property;
- illegal drugs;
- controlled substances where the transaction is unlawful;
- counterfeit goods;
- forged documents;
- fraudulent identification;
- unlawfully obtained personal information; and
- other goods prohibited by applicable law.
Weapons and dangerous items
Users must not list weapons, ammunition, explosives or other prohibited weapons or dangerous articles except where expressly permitted by TrashMart and lawful under all applicable laws.
TrashMart may prohibit categories of items even where possession might be lawful in some circumstances.
Hazardous materials
Users must not list materials that create unreasonable risks to users, including prohibited toxic, explosive, radioactive, biohazardous or otherwise dangerous materials.
Adult and exploitative content
TrashMart may prohibit sexually explicit material, sexual services, exploitative material and content involving minors.
Any sexual exploitation or abuse of minors is strictly prohibited.
Financial and regulated products
Users must not use TrashMart to facilitate unlawful financial services, unauthorized lending, investment schemes, pyramid schemes, fraudulent fundraising or other regulated activities without appropriate authorization.
Animals and wildlife
Users must comply with all applicable laws concerning animals and wildlife.
TrashMart may prohibit listings involving live animals, protected species, wildlife products or other regulated biological materials.
Other prohibited activity
TrashMart may prohibit additional categories where necessary to protect users, comply with law, respond to regulatory requirements, or maintain the integrity of the Platform.
The fact that an item is not specifically named in these Terms does not mean that it is automatically permitted.
16. ILLEGAL OR HARMFUL USE
Users must not use TrashMart to facilitate:
- violence;
- terrorism;
- exploitation;
- trafficking;
- harassment;
- stalking;
- extortion;
- threats;
- fraud;
- identity theft;
- unauthorized access to computer systems;
- malware distribution;
- unlawful surveillance;
- sexual exploitation;
- discrimination prohibited by law;
- or other unlawful activity.
TrashMart may take immediate action where it reasonably believes that activity creates an immediate or serious risk.
17. ACCURACY AND MISLEADING CONTENT
Users must not knowingly publish false, deceptive or materially misleading information.
This includes:
- fake prices;
- fake photographs;
- materially inaccurate descriptions;
- false claims about ownership;
- fake claims of availability;
- false claims of payment;
- false claims of delivery;
- manipulated product condition;
- misleading titles;
- misleading specifications;
- fabricated reviews; and
- deceptive representations about identity or qualifications.
Users should disclose relevant information that would reasonably affect another user's decision to transact.
18. DUPLICATE, SPAM AND MANIPULATIVE LISTINGS
Users must not:
- repeatedly post substantially identical listings to manipulate visibility;
- flood search results;
- artificially inflate engagement;
- use bots or automated systems to manipulate the Platform;
- create multiple accounts to bypass listing restrictions;
- manipulate likes;
- manipulate reviews;
- manipulate reports;
- deliberately interfere with another user's visibility; or
- otherwise attempt to gain an unfair advantage through manipulation.
TrashMart may remove duplicate or manipulative content.
19. MESSAGES AND COMMUNICATIONS
TrashMart may provide messaging functionality to allow users to communicate about listings, wanted posts and transactions.
Users must use messaging responsibly.
Users must not use messaging to:
- harass;
- threaten;
- extort;
- scam;
- spam;
- distribute malware;
- solicit prohibited goods;
- collect personal information for unlawful purposes;
- impersonate another person;
- send abusive content; or
- circumvent Platform restrictions.
Users should avoid sharing unnecessary sensitive personal information through messages.
TrashMart may take action regarding messages where permitted by law and necessary for safety, moderation, fraud prevention, legal compliance or Platform operation.
The Privacy Policy explains how personal information and communications-related data are handled.
20. REVIEWS
TrashMart may allow eligible users to leave reviews.
Reviews are intended to reflect genuine experiences.
Users must not:
- review themselves;
- create fake reviews;
- pay for fake reviews;
- threaten another user to obtain a positive review;
- threaten another user to prevent a negative review;
- coordinate artificial reviews;
- manipulate ratings;
- submit multiple reviews for the same qualifying transaction where prohibited;
- impersonate another reviewer; or
- knowingly submit materially false information.
TrashMart may use transaction-confirmation mechanisms to determine review eligibility.
A review does not necessarily represent TrashMart's opinion.
TrashMart may remove, restrict or investigate reviews that violate these Terms or appear fabricated, abusive, unlawful or materially misleading.
TrashMart will not intentionally manipulate ratings to create a false impression of a user's reputation.
21. TRANSACTION CONFIRMATION
TrashMart may provide a mechanism through which a seller indicates that a listing has been sold and identifies the relevant conversation.
The other party may be asked to confirm or reject whether they participated in the transaction.
Transaction confirmation is intended to help establish review eligibility and reduce fabricated reviews.
It is not a payment-processing service and does not constitute a guarantee that the transaction occurred exactly as described.
Users must not falsely confirm transactions.
False transaction confirmations may result in review removal, account restrictions or termination.
22. VERIFICATION
TrashMart may offer a verification process.
A verified badge indicates that TrashMart has completed its applicable verification process for the account at the relevant time.
Verification does not mean that:
- the user is guaranteed to be trustworthy;
- the user will never commit misconduct;
- all listings are safe;
- all statements made by the user are true;
- TrashMart guarantees the user's transactions; or
- the user is immune from moderation.
Verified users remain subject to these Terms.
TrashMart may conduct additional investigations into verified accounts where appropriate.
TrashMart may suspend or remove verification where:
- verification information is false;
- the account is compromised;
- the user violates these Terms;
- circumstances materially change;
- the badge is misused; or
- removal is reasonably necessary for safety, legal or operational reasons.
Users must not claim to be verified if they have not received a genuine TrashMart verification badge.
23. INDIVIDUAL AND BUSINESS ACCOUNTS
TrashMart may distinguish between individual and business accounts.
Users must accurately represent their account type.
A user must not falsely represent themselves as:
- a registered business;
- an authorized representative;
- a manufacturer;
- an official distributor;
- a professional;
- a government entity;
- or another organization or person.
Businesses remain responsible for complying with applicable laws governing their activities, products, advertising, consumer relationships and tax obligations.
A business designation does not constitute an endorsement or certification by TrashMart.
24. REPORTING
TrashMart may provide reporting tools allowing users to report:
- users;
- listings;
- messages;
- reviews;
- or other potentially problematic content.
Reports must be made honestly and in good faith.
Users must not:
- submit knowingly false reports;
- repeatedly report content solely to harass another user;
- coordinate fraudulent reports;
- use reports to suppress legitimate competition;
- threaten another user with reports;
- or otherwise abuse the reporting system.
TrashMart may restrict reporting functionality for accounts that abuse the system.
A user may have a reporting eligibility status such as `canReport`, which TrashMart may modify where reasonably necessary to prevent abuse.
Reports may be reviewed by TrashMart and may result in no action, content removal, warnings, restrictions, suspension or termination.
Submitting a report does not guarantee a particular outcome.
25. CONTENT MODERATION
TrashMart reserves the right, subject to applicable law, to:
- review reported content;
- remove content;
- restrict content visibility;
- disable features;
- restrict accounts;
- suspend accounts;
- terminate accounts;
- remove verification;
- restrict reporting;
- investigate suspicious behaviour; and
- cooperate with lawful authorities.
TrashMart may take action where it reasonably believes that content or conduct:
- violates these Terms;
- violates applicable law;
- threatens user safety;
- threatens Platform integrity;
- involves fraud;
- involves abuse;
- involves manipulation;
- creates material risk to TrashMart; or
- otherwise warrants intervention.
TrashMart is not required to proactively review every piece of content.
The absence of immediate action does not mean that TrashMart approves or endorses content.
26. ACCOUNT SUSPENSION AND TERMINATION
TrashMart may suspend or terminate an account where permitted by law and reasonably necessary, including where a user:
- violates these Terms;
- violates applicable law;
- engages in fraud;
- repeatedly receives credible reports;
- manipulates reviews;
- manipulates the reporting system;
- circumvents restrictions;
- creates multiple accounts for abusive purposes;
- provides materially false information;
- threatens other users;
- compromises Platform security;
- uses prohibited goods or services;
- or creates serious risk to users or TrashMart.
Where appropriate and reasonably practicable, TrashMart may provide an explanation.
However, immediate restriction may occur where delay could create safety, fraud, legal, security or operational risks.
27. BAN EVASION
A user whose account has been suspended or terminated must not create or use another account to circumvent the restriction.
This includes:
- creating another account;
- using another person's account;
- manipulating identifying information;
- using another person's email address;
- or otherwise attempting to evade enforcement.
TrashMart may restrict accounts reasonably believed to be connected to ban evasion, subject to applicable law and appropriate safeguards.
28. ACCOUNT DELETION
Users may request deletion of their account through the available account controls or by contacting TrashMart.
Deletion may not result in immediate deletion of every record associated with the account where retention is necessary or permitted for:
- legal obligations;
- fraud prevention;
- dispute resolution;
- security;
- enforcement;
- accounting;
- regulatory requirements;
- legitimate operational purposes; or
- other lawful purposes described in the Privacy Policy.
Where content is retained after account deletion, TrashMart will handle it in accordance with applicable law and its Privacy Policy.
29. USER CONTENT
Users retain ownership of content they lawfully own and upload to TrashMart, subject to applicable law.
This may include:
- photographs;
- listing descriptions;
- wanted-post descriptions;
- reviews;
- profile information;
- and other content submitted by users.
By uploading content to TrashMart, you grant TrashMart a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display, transmit and otherwise use that content as reasonably necessary to:
- operate TrashMart;
- display listings and profiles;
- provide Platform functionality;
- distribute content within the Platform;
- improve Platform services;
- moderate content;
- investigate reports;
- maintain security; and
- promote TrashMart using Platform content where appropriate.
You represent that you have the necessary rights to submit the content.
You must not upload content that infringes another person's intellectual-property, privacy, publicity or other legal rights.
30. COPYRIGHT AND INTELLECTUAL PROPERTY
TrashMart and its associated branding, software, interface, designs, logos, names, graphics, text, databases and other Platform materials are owned by or licensed to TrashMart or its operator unless otherwise stated.
Users must not:
- copy substantial parts of the Platform without permission;
- reverse engineer the Platform except where legally permitted;
- scrape the Platform in a manner that violates these Terms or applicable law;
- reproduce TrashMart branding without authorization;
- claim TrashMart's intellectual property as their own; or
- use the Platform to develop a competing service through unauthorized extraction or copying.
Nothing in these Terms transfers ownership of TrashMart's intellectual property to users.
31. THIRD-PARTY SERVICES
TrashMart may rely on third-party services and infrastructure, including hosting, authentication, analytics, mapping, messaging, storage, payment-related external services or other technology providers.
Third-party services may have their own terms and privacy policies.
TrashMart does not necessarily control third-party services.
Where use of a third-party service is necessary for a Platform feature, availability may depend on that provider.
32. LOCATION SERVICES
TrashMart may offer location-based features.
Where enabled, location information may be used to provide features such as:
- community identification;
- nearby listings;
- distance-based discovery;
- local content;
- and location-related marketplace functionality.
Location access is generally optional unless a particular feature cannot operate without it.
Users who do not provide location access may still be able to use other parts of TrashMart, although certain location-dependent features may be unavailable or less accurate.
Users may manage location permissions through their device settings where supported.
Further information about location data is provided in the Privacy Policy.
33. COMMUNITY FEATURES
TrashMart may create geographic or institutional communities based on locations and community definitions established by TrashMart.
Communities may include universities, neighbourhoods, towns or other relevant groups.
Community association may be determined using GPS coordinates.
A post may be associated with one or more relevant communities where its location falls within their geographic boundaries.
Users may have the option to prevent a particular post from being associated with a community.
Users must not manipulate location information for the purpose of obtaining inappropriate community visibility.
Community membership, association or visibility does not constitute an endorsement by TrashMart.
34. SAFETY
Users are responsible for taking reasonable precautions when interacting with other users.
Where meeting another user in person, users should consider:
- meeting in a safe and appropriate location;
- informing someone they trust;
- avoiding unnecessary disclosure of sensitive information;
- inspecting items before completing transactions where appropriate;
- using caution when receiving or sending money; and
- leaving or reporting situations that appear unsafe.
Users should not assume that another user's profile, reviews or verification status guarantees personal safety.
TrashMart does not arrange or supervise physical meetings between users.
35. USER PRIVACY
Users must respect the privacy of other users.
You must not:
- publish another person's private information without lawful justification;
- obtain personal information through deception;
- use another user's information for harassment;
- sell personal information obtained through TrashMart without authorization;
- or use Platform information for unlawful purposes.
TrashMart's handling of personal data is governed by the TrashMart Privacy Policy.
The Privacy Policy forms part of the broader legal framework governing your use of the Platform.
36. SECURITY
Users must not attempt to compromise the security or integrity of TrashMart.
Prohibited conduct includes:
- unauthorized access;
- credential theft;
- malicious code;
- denial-of-service attacks;
- exploitation of vulnerabilities for malicious purposes;
- unauthorized database access;
- reverse engineering for abusive purposes;
- automated abuse;
- scraping that violates Platform restrictions; or
- interference with Platform infrastructure.
Security researchers who identify a potential vulnerability should contact TrashMart rather than exploiting it against users or the Platform.
37. AVAILABILITY AND TECHNICAL LIMITATIONS
TrashMart is provided through software and infrastructure that may occasionally experience:
- outages;
- bugs;
- maintenance;
- network failures;
- device incompatibility;
- third-party service interruptions;
- data synchronization issues;
- delays;
- or other technical problems.
TrashMart does not guarantee that the Platform will:
- always be available;
- operate without errors;
- operate without interruption;
- be compatible with every device;
- always display information in real time;
- or remain unchanged.
TrashMart may modify, suspend or discontinue features where reasonably necessary.
38. INFORMATIONAL ACCURACY
TrashMart attempts to provide a useful and reliable Platform but does not guarantee that all information displayed on the Platform is complete, accurate, current or error-free.
This includes information supplied by users.
Users should verify material information before relying on it in a transaction.
39. NO GUARANTEE OF TRANSACTIONS
TrashMart does not guarantee that:
- a buyer will purchase an item;
- a seller will complete a sale;
- a donor will provide an item;
- a recipient will collect an item;
- an item will be available;
- an item will match its description;
- payment will occur;
- delivery will occur;
- a transaction will be completed;
- another user will behave honestly; or
- a transaction will be free from disputes.
Users enter transactions at their own judgment and subject to applicable law.
40. USER DISPUTES
Disputes between users should first be addressed directly between the parties where it is safe and appropriate to do so.
If a dispute cannot reasonably be resolved, users may contact TrashMart support.
TrashMart may review relevant information and take action where the dispute involves:
- violation of these Terms;
- fraud;
- prohibited content;
- abuse;
- Platform misuse;
- or other matters within TrashMart's moderation responsibilities.
TrashMart is not automatically required to adjudicate every private contractual dispute between users.
Where TrashMart intervenes, its decision regarding Platform enforcement does not necessarily determine the legal rights of the parties to their underlying transaction.
Users retain any rights available to them under applicable law.
41. COMPLAINTS ABOUT TRASHMART
If you have a complaint about TrashMart itself, you should first contact:

42. DISCLAIMERS
To the maximum extent permitted by applicable law, TrashMart provides the Platform on an "as available" basis.
TrashMart does not guarantee that the Platform or user-generated content will always be:
- accurate;
- complete;
- uninterrupted;
- secure;
- available;
- error-free;
- suitable for a particular purpose; or
- free from harmful technical issues.
TrashMart does not guarantee the conduct, identity, competence, reliability, legality or honesty of every user.
Nothing in these Terms excludes or limits liability or rights that cannot lawfully be excluded or limited.
43. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, TrashMart and its operator will not be responsible for losses arising solely from:
- a user's decision to transact with another user;
- a user's failure to verify a listing;
- a user's voluntary transfer of money to another user;
- a user's failure to follow safety guidance;
- inaccurate information supplied by another user;
- disputes between users;
- third-party payment services;
- third-party delivery arrangements;
- events outside reasonable control; or
- unauthorized conduct by another user.
However, nothing in these Terms is intended to exclude liability that cannot legally be excluded, including liability imposed by mandatory law.
Nothing in these Terms removes statutory consumer rights or other legal protections that cannot lawfully be waived.
44. INDEMNIFICATION
To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, costs and reasonable expenses arising from your:
- violation of these Terms;
- unlawful use of TrashMart;
- fraudulent activity;
- infringement of another person's rights;
- misuse of another user's personal information;
- unauthorized use of the Platform; or
- content that you submit to the Platform.
This provision does not require you to indemnify TrashMart for losses caused by matters for which applicable law makes TrashMart responsible.
45. FORCE MAJEURE
TrashMart will not be responsible for failure or delay caused by circumstances beyond reasonable control, including where applicable:
- natural disasters;
- severe network outages;
- major infrastructure failures;
- war;
- civil unrest;
- governmental action;
- public emergencies;
- widespread cyber incidents;
- failures of essential third-party infrastructure; or
- other events beyond reasonable control.
This provision does not remove rights that cannot legally be excluded.
46. CHANGES TO TRASHMART
TrashMart may modify, add, remove or discontinue features.
Changes may be necessary because of:
- technical development;
- security;
- legal requirements;
- user feedback;
- safety concerns;
- operational requirements; or
- changes to the Platform's purpose.
Where material changes affect these Terms, TrashMart will provide notice where reasonably required or appropriate.
47. CHANGES TO THESE TERMS
TrashMart may update these Terms from time to time.
The updated version will include a new "Last Updated" date.
Where legally required, users will be given appropriate notice of material changes.
Where a change is material, you will be asked within the application to read and accept the updated Terms before continuing to use TrashMart, and a record of that acceptance will be kept against your account. You may decline, in which case you may sign out and stop using the Platform.
If you continue to use TrashMart after the effective date of an updated version, your continued use may constitute acceptance of the updated Terms to the extent permitted by law.
If you do not agree to the updated Terms, you should stop using TrashMart.
48. SEVERABILITY
If any provision of these Terms is determined by a competent authority to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it lawful where legally possible.
If it cannot be made lawful or enforceable, it will be severed from these Terms.
The remaining provisions will continue to apply to the extent permitted by law.
49. NO WAIVER
If TrashMart does not immediately enforce a provision of these Terms, that does not mean TrashMart has permanently waived its right to enforce that provision.
A waiver must be understood in its proper context and does not automatically apply to future violations.
50. ASSIGNMENT
Users may not transfer or assign their rights or obligations under these Terms without TrashMart's prior written consent where such consent is legally required.
TrashMart may transfer or assign its rights and obligations in connection with a restructuring, sale, merger, acquisition, transfer of the Platform or other lawful business transaction, subject to applicable law.
51. ENTIRE AGREEMENT
These Terms, together with documents expressly incorporated into them, including the TrashMart Privacy Policy and any further guidelines or policies TrashMart publishes, constitute the agreement governing your use of TrashMart, subject to applicable law.
Where a specific feature has additional terms presented to you before use, those additional terms may also apply to that feature.
If there is an inconsistency between these Terms and a mandatory legal requirement, the mandatory legal requirement prevails.
52. GOVERNING LAW
These Terms are intended primarily for the operation of TrashMart in Nigeria.
Subject to applicable mandatory law, these Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.
Subject to any mandatory rule of law or statutory right that provides otherwise, the courts of the Federal Republic of Nigeria shall have jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Platform.
Nothing in this section removes or limits any right you may have under applicable law to bring proceedings, or to have proceedings brought against you, in a particular forum.
53. DISPUTE RESOLUTION
If you have a dispute concerning TrashMart, you should first contact TrashMart support:
TrashMart will make reasonable efforts to understand and resolve complaints through its support process.
Where a dispute cannot be resolved through support, either party may pursue any remedy or procedure available under applicable law.
Nothing in these Terms prevents a consumer or other person from exercising a statutory right to bring a complaint before a competent regulator, court, tribunal or other lawful authority.
TrashMart does not currently require arbitration, and nothing in these Terms obliges you to waive access to the courts.
54. NOTICES AND COMMUNICATIONS
TrashMart may communicate with users through:
- in-app notifications;
- push notifications to your device, where you have allowed them;
- email;
- messages within the Platform;
- account notifications; or
- other appropriate electronic means.
Push notifications are optional. You may refuse or withdraw notification permission at any time in your device settings without losing access to the Platform, although you may then only see new messages when you open the application.
Important communications may include:
- account security;
- verification;
- moderation;
- reports;
- transaction confirmation;
- changes to the Terms;
- service announcements; and
- support matters.
Users should ensure that their registered email address remains accessible.
55. ELECTRONIC COMMUNICATIONS
By using TrashMart and providing an email address, you consent, where legally permitted, to receiving electronic communications necessary for the operation of your account and the Platform.
Electronic records may be used to communicate information, notices and decisions relating to your use of TrashMart.
Where applicable law requires a particular form of notice, TrashMart will comply with that requirement.
56. THIRD-PARTY LINKS AND SERVICES
TrashMart may contain links, integrations or references to third-party services.
TrashMart does not necessarily control those services and is not responsible for their independent operation, content, terms or privacy practices.
Users should review the applicable third-party terms before using external services.
57. ADVERTISING AND FUTURE COMMERCIAL FEATURES
TrashMart may introduce advertising, sponsorship, business accounts, promoted listings or other commercial features in the future.
Where such features are introduced, TrashMart will seek to identify commercial relationships and disclosures appropriately and in accordance with applicable law.
Users must not falsely represent paid or sponsored content as independent user opinion.
58. BUSINESS AND ORGANISATIONAL USE
Businesses and organisations using TrashMart must ensure that their use of the Platform complies with all laws applicable to their activities.
They remain responsible for:
- product compliance;
- advertising claims;
- consumer obligations;
- licensing;
- taxes;
- required registrations;
- employment obligations; and
- other legal requirements applicable to their business.
TrashMart does not certify that a business is legally compliant merely because it has an account or verification badge.
59. TAXES
Users are responsible for determining and satisfying any tax obligations arising from their activities on TrashMart.
TrashMart does not provide tax, legal, financial or accounting advice.
60. NO PROFESSIONAL ADVICE
Information provided through TrashMart, including environmental, recycling, marketplace or other informational content, is not necessarily professional legal, financial, medical, engineering, environmental or other professional advice.
Users should seek qualified professional advice where appropriate.
61. ENVIRONMENTAL INFORMATION
TrashMart may publish environmental or recycling-related information.
Although reasonable efforts may be made to provide useful information, users should independently verify information where decisions involve health, safety, hazardous materials, regulated waste or other significant risks.
Users remain responsible for complying with applicable environmental and waste-management laws.
62. PROHIBITION ON PLATFORM ABUSE
Users must not interfere with the ordinary operation of TrashMart.
This includes attempts to:
- overload the Platform;
- bypass access controls;
- manipulate APIs;
- circumvent technical restrictions;
- reverse engineer security mechanisms;
- extract data in violation of applicable restrictions;
- introduce malicious software; or
- interfere with other users' access.
TrashMart may restrict or terminate access where such conduct is detected or reasonably suspected.
63. AUTOMATION AND BOTS
Unless expressly authorized by TrashMart, users must not use bots, scripts, crawlers or automated systems to:
- create accounts;
- create listings;
- send messages;
- manipulate likes;
- submit reports;
- manipulate reviews;
- scrape protected data; or
- otherwise interact with TrashMart in a manner that circumvents intended Platform functionality.
64. CHILD SAFETY
TrashMart does not permit the Platform to be used for the exploitation, abuse, grooming, threatening or other harmful treatment of minors.
Any content or conduct involving the sexual exploitation of minors is strictly prohibited.
Users who encounter potentially dangerous activity involving a minor should report it to TrashMart and, where appropriate, relevant authorities.
TrashMart may take immediate action where necessary to protect users.
65. NO IMPERSONATION
Users must not impersonate:
- another user;
- a business;
- TrashMart;
- TrashMart staff;
- a government authority;
- a university;
- a charity; or
- another person or organisation.
Users must not falsely claim to represent TrashMart.
TrashMart may remove impersonating accounts and content.
66. USER RESPONSIBILITY FOR LISTINGS
A user who creates a listing remains responsible for it until it is removed, deleted or otherwise no longer available.
Users should update listings where necessary, including when:
- an item has been sold;
- an item has been donated;
- an item is no longer available;
- the price changes; or
- material information changes.
Users must not knowingly leave misleading listings active.
67. POST REMOVAL AND RETENTION
TrashMart may remove posts from active marketplace discovery when they are:
- sold;
- donated;
- unavailable;
- expired;
- prohibited;
- reported;
- deleted by the user; or
- otherwise no longer appropriate for active display.
Certain records may remain stored for a period after removal where necessary for:
- account functionality;
- transaction history;
- reviews;
- moderation;
- fraud prevention;
- legal compliance;
- dispute resolution;
- security; or
- other legitimate purposes.
Retention periods are addressed further in the Privacy Policy.
68. SURVIVAL
Provisions that by their nature should continue after termination of an account or these Terms may continue to apply.
This includes provisions relating to:
- intellectual property;
- user responsibilities;
- liability;
- indemnification;
- disputes;
- applicable law;
- privacy; and
- records that must lawfully be retained.

- Users must provide truthful and lawful information.
- Reviews, reports and verification mechanisms must not be abused.
- TrashMart may moderate content and accounts in accordance with these Terms and applicable law.
- TrashMart may change or discontinue features.
- Your personal information is handled according to the TrashMart Privacy Policy.
- You remain responsible for complying with applicable law.
- Nothing in these Terms removes rights that cannot lawfully be excluded.
